Notice of Privacy Practices

Your Information. Your Rights. Our Responsibilities.

Effective date: October 21, 2026

This notice describes how medical information about you may be used and disclosed and how you can access it. Please review it carefully. This notice applies to protected health information maintained by Wheelchair Clinic Inc. for its physical and occupational therapy evaluations and related healthcare activities.

Your Rights

You have the right to get an electronic or paper copy of your medical record; ask us to correct your medical record; request confidential communications; ask us to limit certain uses and disclosures; obtain an accounting of certain disclosures; receive a paper copy of this notice; choose someone legally authorized to act for you; and file a complaint without retaliation.

Get an Electronic or Paper Copy

You may request to inspect or obtain an electronic or paper copy of your medical record and other health information we maintain about you. We will provide a copy or summary, usually within 30 days, as required by law. A reasonable, cost-based fee may apply where permitted.

Ask Us to Correct Your Medical Record

You may ask us to amend information you believe is incorrect or incomplete. We may deny a request when permitted by law and will explain the reason in writing, generally within 60 days.

Request Confidential Communications

You may ask us to contact you in a particular way or at a different address. We will accommodate reasonable requests.

Ask Us to Limit What We Use or Share

You may request restrictions on certain uses or disclosures for treatment, payment, or healthcare operations. We are not always required to agree. If you pay in full out of pocket for a service or item, we will honor a request not to disclose that information to your health plan for payment or operations, unless required by law.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures made during the preceding six years. Disclosures for treatment, payment, healthcare operations, and certain other disclosures generally are excluded. One accounting per 12 months is free; reasonable cost-based fees may apply to additional requests.

Get a Copy of This Notice

You may request a paper copy at any time, even if you agreed to receive it electronically. We will provide it promptly.

Choose Someone to Act for You

A legally authorized representative, including a guardian or an individual holding applicable healthcare power of attorney, may exercise your rights. We will verify that person's authority.

File a Complaint

If you believe your privacy rights have been violated, contact Danny Lumpkin, Compliance Officer, at 833-233-7875 or info@wc-clinic.com. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201; 1-877-696-6775; https://www.hhs.gov/hipaa/filing-a-complaint/. Wheelchair Clinic will not retaliate for a complaint.

Your Choices

You may tell us your preferences concerning sharing information with family, close friends, or others involved in your care or payment, and disaster-relief disclosures. We will respect your preferences as required by law. If you cannot express a preference, we may share information as permitted by law when in your best interest. Information may be disclosed as permitted by law to prevent or lessen a serious and imminent health or safety threat.

Uses Requiring Written Authorization

Written authorization generally is required for HIPAA-regulated marketing, sale of protected health information, most disclosures of psychotherapy notes if maintained, and any other use or disclosure for which law requires authorization. You may revoke an authorization in writing at any time, except to the extent already relied upon.

Fundraising

If we use protected health information for fundraising communications as permitted by law, we will offer an opportunity to opt out. Additional requirements apply to fundraising using substance use disorder records protected by 42 CFR Part 2.

Our Uses and Disclosures

We may use and disclose protected health information for treatment, payment, healthcare operations, and other purposes permitted or required by law, subject to applicable restrictions.

Treatment

We may use and disclose relevant information to provide and coordinate healthcare. For example, a Wheelchair Clinic therapist may share evaluation findings with a prescribing physician or other treating professional to coordinate mobility and seating needs. Disclosures to ATPs, DME suppliers, and other partners depend on their roles and the applicable legal basis.

Healthcare Operations

We may use or disclose information to operate our practice, review clinical quality, train personnel, manage services, and improve care. For example, we may review evaluation records to assess documentation quality.

Payment

We may disclose information to obtain payment, verify eligibility, process claims, or support reimbursement. For example, we may share evaluation information with a health insurer as appropriate.

Other Permitted or Required Disclosures

Subject to applicable legal conditions, we may disclose information for public health and safety; reporting abuse, neglect, certain adverse events, or product safety concerns; legally authorized research; compliance with law and HHS privacy investigations; organ and tissue donation; medical examiner and funeral director functions; workers' compensation; law enforcement; health oversight; certain military, national security and government functions; and valid legal proceedings. Stricter protections may apply to specially protected records.

Special Protections for Substance Use Disorder Treatment Records

Certain substance use disorder treatment records are protected by 42 U.S.C. § 290dd-2 and 42 CFR Part 2. Wheelchair Clinic may receive such records from other providers. When we receive or maintain records subject to Part 2, we use and disclose them only as permitted by applicable law, including any applicable patient-consent requirements and further-disclosure restrictions.

Part 2 Protections in Legal Proceedings

Part 2-protected records generally cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the patient's written consent or a qualifying court order with the required subpoena or similar legal mandate. Such restrictions may apply even when a disclosure otherwise would be permitted by HIPAA. Where permitted, Part 2 records disclosed with patient consent for treatment, payment, or healthcare operations may subsequently be used or disclosed as HIPAA allows, subject to continuing Part 2 restrictions, including on proceedings against the patient.

Fundraising Involving Part 2 Records

If we use Part 2-protected information for legally permitted fundraising, we will give applicable advance notice and a clear opportunity to decline such communications.

Additional State and Federal Protections

Certain information, including some mental health and substance use disorder records, may receive additional protection under federal or state law. When an applicable law is more protective than HIPAA, we follow the more protective requirement.

Our Responsibilities

We are required to maintain the privacy and security of protected health information; provide this notice; follow the notice currently in effect; notify affected individuals after a breach of unsecured information when required; obtain written authorization when required; honor applicable special protections; and respond to privacy-rights requests within legal timeframes. We will not use or disclose information other than as described here unless permitted or required by law or authorized in writing.

Changes to This Notice

We may revise this notice and, when legally permitted, apply revised terms to information already maintained and received in the future. The current notice will be available upon request, in our office, and at www.wc-clinic.com. We will communicate material changes as required by law.
